§ 12.6.2. Tree removal permit not required.

  • A.

    A tree removal permit is not required for a protected tree (as defined in this article) to be removed that is diseased and deemed unsafe as verified by written documentation signed by a licensed professional (forester, arborist or horticulturalist). Said documentation is required to be filed by the property owner or his/her designated representative with the town clerk.

    B.

    Lands classified as bona fide agricultural land for ad valorem taxation purposes pursuant to F.S. § 193.451 are exempt from this chapter, with the exception that a tree removal permit is required for the removal of any grand tree.

    C.

    Removal of one protected tree between five-inch and ten-inch DBH per property.

    D.

    Any tree(s) listed as exempt under the ordinance from which this section was derived or the transplanting of any protected tree less than five-inch DBH.

    E.

    Upon the declaration of a state of emergency pursuant to F.S. ch. 252, the town commission or their designee may temporarily suspend the enforcement of the requirements of this section in order to expedite the removal of damaged and destroyed trees in the interest of public safety, health, and general welfare. However, the removal of undamaged trees during the suspension of this section shall constitute a violation of this section punishable according to this chapter.
