§ 22-1. Interlocal agreement with the county to provide fire prevention and protection services.

  • (a)

    The town commission hereby finds and declares that on September 23, 2003, the county and the town entered into an interlocal agreement for fire suppression and fire responder services. Under the terms of the interlocal agreement, the county has agreed to provide fire suppression and first responder services within the boundaries of the town through the county municipal fire service unit. The interlocal agreement further provides that the county, upon request of the town commission, will enact an ordinance expanding the boundaries of the existing county municipal fire service unit (hereinafter MSTU) to include the town and the town commission will enact an ordinance consenting to the inclusion of the entire town within the MSTU. The town commission has requested that the county enact an ordinance expanding the boundaries of the existing county MSTU to include the town.

    (b)

    The town commission consents and agrees to the amendment of county ordinances to expand the boundaries of the county municipal fire service unit to include all of those lands lying within the municipal boundaries of the town which may be amended from time to time. Further, the town commission agrees that the county shall have the power to amend the county ordinance expanding the county municipal fire service unit, without the consent of the town commission, including but not limited to increase or modify the boundaries of the unit and amendments to provide for assessments or an assessment/ad valorem tax.

    (c)

    The town's participation in the county municipal fire service district shall expire September 30, 2013.
